Commonwealth Court has ruled that development of four Penn Township fracking sites can continue as scheduled.
The Tribune-Review reports that Protect PT, an advocacy group that had appealed the Penn Township Zoning Hearing Board’s decision to allow four special exceptions for well pads for Apex Energy, has lost its second appeal on this issue. A judge’s opinion written by Judge Robert Simpson said that the group did not present enough evidence to make them think the zoning board did not do its due diligence.
Protect PT is considering taking the case to state supreme court.
