A Westmoreland County Judge has declared a mistrial in an attempted homicide case involving two men from Monessen.
The Tribune-Review reports that Common Pleas Court Judge Christopher Feliciani said the mistrial declaration in the trial of Joseph Heath the III and Rashawn Ford was necessary as some evidence to aid the prosecution was turned over too late and the defense could not adequately prepare for the cross-examination the alleged victim Timothy Kershaw and another witness who previously testified. Feliciani added that this was not done intentionally by the prosecution.
Both men will remain in jail until at least next week, when the judge will have a hearing to determine if they should be released on bail pending a new trial.
