
A Westmoreland County Judge denied a request to overturn the conviction and sentence of a 2016 murder in Latrobe.
The Tribune-Review reports that Judge Meghan Billik-Defazio denied the request for 20-year-old Austin Krinock of Johnstown, who was found guilty in August of second-degree murder in the death of Daniel McNerny. Krinock’s attorneys claimed that the jurors did not have enough evidence to convict, and that there were no errors made in the jury selection process.
Krinock, along with Colin Gearhart and Zachary McGrath had conspired to rob two Pittsburgh drug dealers when McNerny tried to intervene.
Krinock was sentenced in December to 34 years to life in prison, while Gearhart will have his trial in March.
