
Westmoreland County prosecutors say that defense arguments to dismiss a rape case should be rejected because the arguments are based on misrepresented facts.
The Tribune-Review reports that the case in question is for 53-year-old John Kunco of Harrison, who has served more than 28 years in prison in a 45 to 90 year prison sentence for the rape of a woman in New Kensington in 1990. His sentence was vacated last May by Judge Christopher Feliciani, who called into question the evidence in the original trial.
Kunko’s appeal is being handled by the Innocence Project of New York.
