The state Supreme Court has heard arguments stemming from a lawsuit filed by a gun group and gun shop. The two assert that State Police have failed to adequately manage a background check system and that’s resulted in impeded firearms sales. In the lawsuit, Firearms Owners Against Crime and Landmark Firearms assert that the PSP’s chronic understaffing has led to unnecessary delays in giving approval for eligible, would-be gun-buyers. The Attorney General’s Office, on behalf of the PSP, had argued that the agency has sovereign immunity, which would protect it from being forced to shift staffing to meet the demands made by the gun group.
