A state court ruling from last year on reimbursing injured workers for the cost of CBD oil is being appealed.
The original suit argued that the costly oil derived from cannabis plants should be paid for by employers under Pennsylvania’s workers’ comp laws. If the ruling stands, it could potentially force businesses to cover all sorts of dietary supplements and over-the-counter treatments following workplace injuries. Attorney Mark Schmidt had sought reimbursement for the product for his own use but the firm that employs him said no.
That led to administrative appeals and a Commonwealth Court case, which was decided in November.
