
A judge has dismissed DUI charges against a Greensburg woman who was arrested after a crash in her driveway.
Greensburg police had charged 58-year-old Mary Britz with DUI after she collided with another car in her driveway as she was backing out of her driveway, but her car never made it to the street. The Tribune-Review reports that defense attorney Patricia Elliott-Rentlers said that DUI charges can only be filed if the car was on a public roadway. Police had said that she failed sobriety tests, and her blood alcohol level was four times the legal limit.
Judge Christopher Feliciani said that the charge should be dismissed because the law barred prosecution, and praised the police for intervening and making sure that a drunk driver did not get out on the road.
