Lawyers for John Kunco are petitioning a judge to have his rape case dismissed.
The Tribune-Review reports that Kunco has served nearly 30 years in prison for the rape of a New Kensington woman. In court motions filed on Thursday, lawyers said that missing evidence and lost testimony through the deaths of the alleged victim and an investigator should stop the case from moving forward.
Kunco was convicted in 1991 for the rape of the woman the year before. A new trial was ordered after he served 28 years in prison.
