The trial for a Latrobe man charged in the murder of Daniel McNerny got underway yesterday.
Opening statements were heard in the trial of Colin Gearhart, who was one of three men charged with second-degree murder in McNerny’s death, who was killed as he tried to stop the robbery in January of 2016. In opening statements yesterday, Defense Attorney Michael DeMatt did say that Gearhart was present for the murder, but was not involved in the killing itself. District Attorney John Peck said that Gearhart was in on the planning of the robbery as an act of revenge for a verbal insult earlier in the month. He also said Gearhart could have stopped things, but decided to let things run their course. Testifying yesterday were two men who were targets of the robbery.
The trial continues today.
